We had the pleasure of discussing the annulment of national arbitration awards in a panel of experts on September 8th 2017 in the beautiful city of Trujillo. The discussion with distinguished jurists like (from left to right in the photo) José Antonio Sánchez Rodríguez, Richard Martin Tirado, Ricardo Gandolfo Cortés, Gustavo de Vinatea and Enrique Varsi, took place within the framework of the VI Regional Arbitration Congress, organized by the Peruvian Institute of Arbitration and the Chamber of Commerce of La Libertad. We met on Saturday morning, September 2nd. 2017, with judges from Lima, Lima Norte, El Santa and Junín, with the idea of exchanging criteria on how to strengthen the argumentation of the judicial decisions they make every day. Twenty years have passed since we began training in reasoning and argumentation in the framework of the programs of the Academy of the Judiciary. In these two decades the judicial argumentation is superior to what we found in the decade of the 80s and the beginning of the 90s, but even the style in the use of an old-fashioned language or full of technicalities and the lack of order in the structuring of the arguments are still pending problems.
It is necessary to bear in mind that, as a result of democratization in the exercise of public powers, the communicative style of the national states has also been changing, in order to be more friendly with the citizens. Among us, the binding precedent 120-2014-PCNM encourages judges to write more clearly. In the same line goes the obligation of the judiciary to make the jurisprudence understandable, according to Legislative Decree No. 1342 published last summer.
